1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and the Service Provider regarding your use of the AI character chat application (the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Service Description

Our App is an AI-powered character chat application that provides:

  • Interactive conversations with AI-generated characters
  • Personalized AI character personalities and responses
  • Character customization and creation features
  • Chat history and conversation management

2.1 Service Limitations

  • The App does not provide medical, psychological, therapeutic, legal, or financial advice
  • AI-generated responses are algorithm-based and may not always be accurate or appropriate
  • We are not healthcare providers and assume no professional responsibilities
  • The App should not be used for emergency situations or crisis management

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old to use the App.

3.2 Account Creation

To access certain features, you must create an account by providing a valid email address. Additional user profile information and account settings are optional.

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring the accuracy of your account information

4. Subscription and Payment

The App offers users the option to access full features through a subscription plan. You can choose between monthly or yearly subscriptions. However, basic app functionality is available free of charge.

When you make a purchase, the subscription fee will be charged to your App Store or Google Play account upon confirmation.

Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the current subscription period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period at the original cost.

You can manage your subscriptions and turn off auto-renewal by accessing your App Store or Google Play account after purchase.

5. User Content and Conduct

5.1 Your Content

When using the App, you may create, share, or input content such as:

  • Messages and conversations with AI characters
  • Custom character profiles and settings
  • Account information and preferences

You retain ownership of your content but grant us the right to use it to provide our services.

5.2 Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Share inappropriate, offensive, or illegal content
  • Attempt to circumvent security measures or access restrictions
  • Use the App for commercial purposes without authorization
  • Reverse engineer, modify, or create derivative works of the App
  • Share your account credentials with others

5.3 Content Monitoring

We reserve the right to monitor user content to ensure compliance with these Terms and maintain a safe environment, but we are not obligated to do so.

6. AI and Data Usage

6.1 AI Processing

Your conversations are processed by AI service providers (OpenAI and Google Gemini) to generate character responses. By using the App, you consent to this processing as described in our Privacy Policy.

6.2 Data Collection and Use

We collect and use your data as outlined in our Privacy Policy, including:

  • Personal information for account management
  • Usage data to improve the App
  • Device and location data for functionality and analytics
  • Conversation data to enhance AI responses

6.3 Data Security

We implement security measures to protect your data, including encryption and secure data transmission, as detailed in our Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE SIX MONTHS PRECEDING THE CLAIM.

10.3 Technical Limitations

We are not responsible for:

  • App performance issues due to internet connectivity or device limitations
  • Data usage charges from your mobile provider
  • Device battery drain or storage limitations
  • Compatibility issues with your device or operating system

You understand and agree that:

  • AI-generated content may not always be accurate or appropriate
  • You are solely responsible for your decisions and actions based on AI interactions
  • We make no guarantees about the App's availability, performance, or results

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or conduct while using the App

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

  • Cancelling your subscription through your account settings
  • Uninstalling the App from your device
  • Contacting us to request account deletion

13.2 Termination by Us

We may suspend or terminate your access to the App immediately, without notice, if you:

  • Violate these Terms
  • Engage in harmful or illegal activities
  • Fail to pay applicable fees
  • For any other reason at our discretion

13.3 Effects of Termination

Upon termination:

  • Your access to the App will cease
  • Your account data may be deleted
  • Outstanding payment obligations remain
  • Provisions of these Terms that should survive will continue to apply

Your continued use of the App after changes are posted constitutes acceptance of the new Terms.
